Hi
I was in the US on H1 VISA and am filing my returns as a non-resident alien. Can I claim Standard deduction of $5150 instead of itemized deductions under the US-INDIA treaty. |

You can only claim the $5,150 standard deduction under the treaty if you were a student on a F-1 visa in 2006.
Otherwise, the treaty exemption is NOT available to you. Hope it helps!
