I'm a german citizen.
Starting January 2007, I was in the US for 4 months as a student on an M1 visa. I then returned to germany, got a J1 visa and stayed in the US as a trainee from June 2007 until June 2009. I left the US end of June 2009. For 2008, I filed a 1040NR-EZ and 8843, and my federal taxes were refunded. Am I still considered a non-resident for 2009, even though I was in the US for a total of more than 2 years? My J-1 trainee visa duration was 2 years, so I should be exempt, right? If I can still file the non resident forms, do I somehow have to clarify this situation on the form? |

You are still a non-resident alien, because the German-U.S. Tax Treaty exempts J-1 trainees for up to four years. Tax Year 2009 was only your third year, so you are good.
However, as a trainee, your treaty exemption amount is limited to $9,000.
