I have a quick question. I am on a J1 visa as a research Scholar and intend to stay beyond the 2 year tax treaty (UK to US). My visa was granted for 5 years. I arrived in Febuary 2008 and filed for my 2008 taxes correctly. At the time I was not expecting to stay beyond two years and claimed back the 2008 taxes. I have paid all of my 2009 income taxes.

At what date do I have to pay back the 2008 taxes retroactively? Is it when I file my 2009 taxes in April or on the 25th February when my two years are over?

Default The sooner, the better

If you know for fact that you will exceed the two year exemption period, then you should amend your 2008 return and pay the back taxes as soon as possible.

While the IRS MAY waive the late-payment penalties, by law they CANNOT waive the interest due, and the longer you wait, the higher the interest will be.
