Throughout 2009 I was an F1 visa holder on OPT (optional practical training). I got married to a US citizen on June 20, 2009 but I have yet to receive my green card.
My employer gave me a 1099-misc instead of a w2. I earned around 20,000 ![]() My questions are: 1. Can I file for taxes together with my wife without giving up my Philippines-US tax treaty exemptions? 2. If so, what forms do we both need to fill out? 3. Do my wife and I need to file separate forms instead of the usual form that married US citizens file together (1040)? 4.What does "married filing separate mean" and should we do this? 5.Since I got 1099-misc, am I still obligated to pay the employer tax or am I exempted since I am an F1 visa holder? 6. Any other advice as to how my wife and I should file taxes? Thank you so much for your time! |
