Default F1 Stocks Taxes -> Dropped out of College in 2009. How?

Hi,

If I could receive a little bit of help, it will be the happiest day in 2010 day for me!


In 2009 I traded stocks in US on F1 Visa.
In 2009 I dropped out of College and returned to Germany.

In 2008 I worked on campus and my student advisor told me I do not have to file anything, because I earned less than $3400.

Now, stocks:

Net Realized Gain/Loss is $1,000.48.

Scottrade sent me 1099 Form today.

Now, my question: Do I need to file anything, since it is less than $3400?

If I do, how do I pay taxes from abroad?


I googled a lot. To be honest I googled for the last half of a year, but the Tax due is approaching, and I am still there where I began.

Some say I need to file 8443, I need to file 1040NR, some say 1099. Jesus!

Germany has a treaty with 0% rate for capital gains.

Does this mean I do not pay anything? Or do I still pay federal and state tax?

Default Return required

Since you traded stocks while in the U.S., you must file a return (Form 1040NR with Schedule D) to properly account for that trade.

You would also submit Form 8843 with the return.
