Mailing Address - Where to Send Form 843?

Form 843 is filed to get a refund of wrongly withheld Social Security and Medicate Taxes.

Its usually filed by F1 Students in Optional Practical Training, whose Taxes are withheld in error.

The mailing address of Form 843 is the service center, where you would be required to file a current tax return for which you are claiming refund.

Default is there a deadline to file for refund

Hi,
i came to USA in july 2005, was a student till April 2007 and was on OPT from May 2007 till Oct 2008 (when i became H1B).

and i filed 1040EZ(2007) and 1040(2008) forms for tax return online without any professional help

after all these years, i just realized that my employer deducted social security and medicare from my paycheck.

was i suppose to pay those taxes or it was just an error on part of my employer. is it too late to file for a refund now?

please help me. i would not mind it if the amount was small but it totals to about $5k.

You can do nothing for 20065 and 2006; too late due to statute of limitations.

For 2007 and 2008, you have to amend your returns to re-instate your non-resident alien status. Once that is done, then (and only then) can you submit Form 843 and 8316 to get the FICA taxes refunds.

From state to finsih, the process will take about 6-8 months.
