I arrived in the US in October 2008 on an H1B visa. I'm filing for 1040NR-EZ for Federal Tax and I had no problems filling it in.
However, since I'm in California, I also have to fill in form 540NR and it requires my wife's ITIN no matter if we decide to file jointly or separately. She doesn't have it yet and she probably won't get one before the April 15 deadline. What should I do? And what should my filin status be? Married filing jointly or married filing separately? Thanks a lot! |

Go ahead and file Married Filing Separately WITHOUT the ITIN.
California will accept it without the ITIN; one of two states that do.
