Default Resident or Non Resident

Hi
My stay in US as follows with H1-B

Jul 15, 2006 - Dec 31, 2006
Jan 01, 2007 - Jan 26, 2007
Feb 09, 2007 - Dec 31, 2007

My wife and two kids entered US on Feb 09, 2007 and are living with me.

I would like to know our residency status and which tax form should I fill?

I work (research) with an University and availed tax treaty benefit (article 22) for 2006. How to pay back the tax for 2006 as well as I am planning to stay for the third year?

You will file your 2007 tax return as residents Married Filing Jointly and claim exemption for your kids. Attach W7 for wife and kids with your tax return. This way you will get much more deductions than any other way.

Your income is subject to FICA taxes. Check your W2 to see if employer is deducting social security and Medicare taxes or not.

About your 2006, you need to check if you are eligible for treaty benefit or not.
