Hi,
Has anyone changed from H-1B to F-1 visa? I was working under H-1B visa for 3 years (2005-Jan 2009) after my master's study (F-1 visa). I was paying resident tax since I stayed in the US more than 5 years. In Jan 2009, I started my PhD study in a different school from my previous one (back to F-1 again). The school's payroll office told me that since this is "the first" F-1 visa "under this school's name", I am a non-resident alien. No FICA was deducted from my assistantship income in 2008. Is that right? I have two W-2 forms in 2008, one from previous employer, and one from school. Should I file 1040? Will it be a problem since 1040 requires Medicare tax but I had none on my 2nd W-2? Thanks!! |

Hello
F1 visa holders are exempted (for upto 5 years) from FICA (Social Security and Medicare Taxes) So if you have enjoyed F1 Masters (2 years), you still have 3 more years in F1, to enjoy your exempt status. Hope it helps!
