Hi,
I was on F1 status for 2 years of bschool and graduated in May 2008. I joined my current company in August 2008 on OPT. They filed for my H1B which I received in July 2009. For the period of August - July I was paying Social Security and Medicare Taxes. Do I qualify for a refund of these taxes? It is important to mention that before I got into F1 status, I was working previously on H1b for 3 years and L1 before that for 1 year. Any help will be greatly appreciated. I am based in the bay area, CA. Thank you, Manu |

You became liable for FICA (Social Security and Medicare) taxes the day your H-1B visa became effective. These taxes are NOT refundable if paid during H-1B status.
