Default F2 to F1 and claim tax treaty

My wife changed from F2 to F1 in USA. In 2007, She went back to China for a short visit, and re-entered USA as F1 student. Could she now claim the tax treaty? Appreciate your help!

Yes, in my opinion, the U.S.-China tax treaty would apply.

That is good, we can claim it for 2009. But we didn't claim it for the 2007 and 2008, just curious, is it possible to get some money back by claim treaty benefits for 2007/2008 and how?

Default Amend 2007 and 2008 Tax return

You need to amend your 2007 and 2008 returns by submitting Form 1040X.
