Hello everybody. This is my case.
Moved to US in Aug 2006 on F1 visa Aug 2006- Dec 2006 F1 Jan 2007- Dec 2007 F1 Jan 2008- Dec 2008 F1 (Graduated in December of 2008) Jan 2009- Sep 2009 OPT Oct 2009- Dec 2009 h1B And from jan 2009 to sep 2009 my ssn and medicare taxes were not deducted by my employer because he knew those shouldnt be deducted when you are on opt. From 2006-2008 i filed the 1040 nr ez and 8843with the Us-india tax treaty as a non resident alien. Now what should i file for 2009? Am i a non resident or a resident alien? Should i quality the substantial presence test. What tax forms should i file for 2009? Iam confused. I will appreciate the help. Thanks in Advance. Vijay. The SPT does NOT apply while you are on F-1 visa, so you will file as a non-resident alien, filing Form 1040NR-EZ and 8843 one last time.
