The Making work pay Tax Credit - H1B visa taxes - TN visa taxes - L1 Visa taxes All H1B, L1, TN visa tax payers, are eligible for the Making Work Pay Tax Credit as long as they are residents (stayed for more than 183 days in US during 2009) and file Form 1040. F1, J1 International Students who are Non Residents are not eligible for the Making work pay Tax Credit. For 2009 it is $400 if Single and $800 if Married. Your company's payroll department will take care of getting you the credit, and you will see the increase in your paycheck. You need not file it in your tax return. However, an employee with multiple jobs or a married couple whose combined income places it in a higher tax bracket should consult the IRS withholding calculator and, if necessary, submit a revised Form W-4 Now married H1B, TN, L1 visa tax payers can claim their credit even if their spouse and children have ITINs in H4 visas, other dependent visas. Could you explain the amount of making work pay tax credit? If a resident alien on H1B visa files 1040, can he claim 800$ credit with a spouse on H4 who has an ITIN or he can only claim 400$ since the spouse doesn't have a SSN?

You are eligible for the Making Work Pay credit even if one or both of you have an ITIN, just as long as you file as a resident alien.
So a couple would normally get $800 for this credit.

Could anyone tell me if I can claim Making Work Pay Credit on my 2009 tax return if I file as resident alien due to being in the country on F-1 visa for more than 6 years?

Work Pay Credit F1 visa taxes - F1 Resident Aliens are eligible, F1 non resident aliens are not.
