Hi,
I'm an intern from Germany, 24 years old, single, student with a J-1 Visa working for a company in California. Now, I have to file a tax report and although I've used this great software here, I'm not sure whether everything is correct. At first a general question: Am I a student or a trainee? That's very confusing because my visa sponsoring agency (GACCNY) has sent us a 8843 form where they have already entered something in the trainee section. But according to their website, they are only allowed to support internship programs and not trainee programs. Secondly, which builts on the last question, do I apply for the $9000 tax treaty exempt or not? I'm a little bit confused by interpreting the articles of the publication 901 and therefore I'm not sure whether this applies to me or not. Thirdly, am I allowed to don't use this tax exempt? I'm not really familiar with German taxes but couldn't it be the case, that I will save money when I will pay the taxes in the USA instead of Germany? I hope, that someone can help. You are a trainee, and I believe gthe $9,000 treaty exemption DOES apply. You can also daily living expenses since the duration of your training is LESS than one year.
