Question J1 holder seeking some brief advice

Hi,
I hold a J1 visa and I need to file my taxes. I am a trainee and there is a treaty between US and my home country which covers up to $5000.

I arrived in August 2008 in the US so I've been here for about 140 days (therefore I do not qualify as a resident). My wage totaled approx. $15100 with $1030 taxes payed to federal government and approx. $500 to state.

I was trying to use the software on this website but could not list the $5000 (covered by the treaty). Anyway, after filling in with all the info the software says I owe about $200 to the IRS. H&R block (using with their software and the same 1040NR form) told me that in fact i should receive about $800 back from federal and some $150 from state.

Can I take the $3500 exemption and at the same time use the $5000 ? In the 1040NR form this would be specified on 6. but not referenced to anyplace else. Should I deduct from the approx. $15100 the $5000 and continue from there? Or how should I fill this in?

A second question as well: can I and should I also list my wife and son (both on J2) on the 1040NR ? If I will list (at least) my wife, will there be any other deductions? If so, I will also need to file for a TIN for her, right?

Default J1 Trainee Tax Treaty Form 1040NR Taxes - Non Resident Tax Return

Hello

1. The 1040NR-EZ Tax Software covers F1, J1 Students. That is the reason, you are not getting tax treaty coverage for J1 Trainee.

2. Yes you cannot claim dependents in Form 1040NR, unless you are from India, China or South Korea.

3. Depending on your Foreign Country, you can claim Tax Treaty benefits in Form 1040NR.

Thanks for the answer. I am from eastern europe so i won't be able to add my wife and son as dependents.

How about the 3500 exemption ? Will I be able to claim this?

Yes you can claim Standard Deduction and Tax Treaty benefits if available. You just cant claim deductions for dependents.
