Sorry, but this is your first year in the U.S. for purposes of the SPT. Thought you have met the Substantial Presence Test, you must be in resident status EVERY day to file as a resident alien.
You are a dual=status alien; file as such.

I haven't gone out of the country since "January 14, 2007". Would you still suggest filling dual status??- or have you just mistaking because of the wrong quotation in the previous msg? :
"So if you are in US on H1B, since Jule 15, 2008 you are considered a Resident Alien for Tax purposes, and eligible to file Form 1040" Thanks so much!!! |

Like David says, you are a Dual Status Alien. Time in F1 and OPT is under Exempt Status = Non Resident in 2008 Time in H1B meet SPT test = Resident in 2008 If you are a Non Resident and Resident in the same year, you are a dual status alien.
